These Terms of Service (“Terms”) constitute a binding legal agreement between you and Travoplanners (referred to as “we,” “us,” “our,” or “Travoplanners”). By accessing or using www.travoplanners.com, or any other related services (collectively, the ‘Service’), you agree to these terms in full.
1. Nature of the Service
Travoplanners operates solely as an intermediary and booking agent. We do not own, operate, or control airlines, hotels, tour operators, car rental companies, cruise lines, or any other travel supplier. All travel services are provided directly from the service providers to you by Travoplanners.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts. By using the Service, you represent and warrant that you meet these requirements.
3. Account Registration
You may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Bookings, Pricing & Payments
4.1 All bookings are subject to availability and final confirmation by the third-party supplier.
4.2 Displayed prices may change until payment is completed and the booking is confirmed.
4.3 You authorize Travoplanners (or its PCI-DSS-compliant payment processor) to charge the total amount shown, including taxes, supplier fees, and our service fees.
4.4 We do not store full payment card numbers on our servers.
5. Cancellations, Changes, Refunds & No-Shows
5.1 Every booking is governed exclusively by the cancellation, change, and refund rules of the third-party supplier. These rules are disclosed before you confirm payment.
5.2 Travoplanners has no authority to refund or waive supplier-imposed fees.
5.3 Any refund or credit, if granted by the supplier, will be processed back to the original payment method minus any non-refundable Travoplanners service fees (where applicable).
6. Your Responsibilities
You are solely responsible for:
- Providing accurate traveler information
- Obtaining valid passports, visas, vaccinations, and all required travel documents
- Complying with all entry, exit, health, and security requirements of every destination and carrier
- Arriving on time for flights, check-ins, and tours, Travoplanners is not liable for any loss, expense, or denial of boarding caused by your failure to meet these obligations.
7. Prohibited Conduct
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
8. Intellectual Property
All content, trademarks, and software on the Service are owned by Travoplanners or its licensors. You are granted a limited, non-transferable license to use the Service for personal, non-commercial travel bookings only.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Travoplanners AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR TRAVEL OPPORTUNITIES), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID Travoplanners IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Travoplanners and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Force Majeure
Travoplanners is not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, labor disputes, or supplier bankruptcy.
13. Governing Law
These Terms are governed by the laws of the State we are located in, without regard to conflict of law principles.
14. Binding Arbitration & Class Action Waiver
14.1 Agreement to Arbitrate
You and Travoplanners agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (including the validity, enforceability, or breach of this arbitration provision) will be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.
14.2 Arbitration Location & Procedure
Arbitration will take place in the State where we are located (or, if you prefer, by telephone or video conference). The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14.3 Costs
Each party will bear its own costs and attorneys’ fees. However, the arbitrator may award the prevailing party reasonable costs and fees if permitted by law.
14.4 Class Action Waiver
You and Travoplanners agree that any arbitration or court proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. If, for any reason, a claim proceeds in court rather than arbitration, each party waives any right to a jury trial.
14.5 30-Day Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice to support@travoplanners.com within 30 days of first accepting these Terms. Such notice must include your full name and a clear statement of intent to opt out.
14.6 Severability
If any part of this arbitration provision is found unenforceable, the remainder will remain in full force and effect.
15. Changes to Terms
We may modify these Terms at any time. The updated Terms will be posted with a new “Effective Date.” Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
